依据Barclays Capital的预估，占几近250亿美元销售额的创新药从2011年起开始迎接专利失效问题，2012年将剧增，结果有几近350亿美元的药会失去专利的保护。
到2015年为止，畅销药的专利失效，各开发公司以副厂药面对分食市占率和利益的其他公司之竞争。现已变成制药公司无法驱逐副厂药的时代。持续Pfizer等技术创新的制药公司眼见Lipitor等畅销药的专利失效，为维持在市场的地位正进行各种合作和M&A等。
由于医药品新兴市场的迅速成长及需求扩大，2005年全球12％市占率，预计于2015年倍增为28％。以中国作为中心的17个市场，从有魅力的日本市场朝东南亚市场急速高龄化，成为品牌副厂药"首次上市"的绝佳机会。
依据IMS的最近报告，在美国最多、处方药上位前10种都是副厂药，前25位的品牌药仅3种。Pfizer的Lipitor、Sanofi-Aventis/BMS的Plavix及Merck的Singulair有3种预计将于2012年失去专利的保护。
